What is unit title ownership and why is it unfavourable?


Unit title ownership (also known as 'strata title' or 'stratum estate') is common in a building where there are multiple owners, such as an apartment block. As a unit owner you own your particular apartment or unit and any accessory units, including garages, private courtyards and storage areas contained in the record of title. The ownership of the common property (eg lifts, laundries, lobby areas, driveways and gardens) is undivided  and shared equally amongst the unit owners. 

Wherever possible, its best to convert any sort of shared ownership lease to a fee simple title. Having absolute ownership of your property allows for more freedom when it comes to alterations, and will be substantially more attractive to buyers.   1. You provide us with your unit title address and we will send you a conversion proposal and a memorandum of understanding (MOU)
  2. An infrastructure report is prepared
  3. A topographical survey is undertaken of the properties, this will include detail relating to drainage, accessways and services
  4. A draft subdivision scheme Plan for the conversion to fee simple lots is produced for your approval
  5. An application is made to council for subdivision consent to the conversion
  6. A conditional subdivision consent is granted for the conversion by council
  7. The conditions of the subdivision consent are undertaken
  8. A land transfer survey plan is prepared, pegging of boundaries undertaken and as-built plans are finalised
  9. Application is made to land Information New Zealand (LINZ) for approval as to survey
  10. Applications are made to council under s.223 and 224c of the RMA
  11. Our lawyer contacts you and completes anti money laundering ID due diligence
  12. Mortgagee’s consent to the conversion is requested (if required)
  13. Final documents are collated, and an application is made for the new titles
  14. New fee simple titles are issued in each registered proprietor’s name(s)
